What happens when you write to a Minister?

 The abuse of

  • Ministerial Briefings

and

  • The "Nil Response Required" approach to Grievances and complaints

 

by senior officers of Education Queensland seems to encourage Queensland school principals to abuse the MUP and Grievance policies -

and to drive good Queensland classroom teachers into ill health and out of work.

 

  • When you write to a Minister or to a senior public servant, they do not actually read your letter.

 

  • A sanitised version of the issues raised in your letter is prepared by a public servant.

 

  • Anything troubling is edited out of the sanitised version of your letter so that the Minister does not "know".

 

  • This is called a "Briefing for the Minister". It is a sort of alibi that proves that the Minister did not "know" and was not "told'.

 

  • Sometimes the person whose behaviour you have complained about may write this briefing.

 

  • This person doesn't have to declare their conflict of interest.

General Briefing Note to The Director-General.

This General Briefing Note to The Director-General is dated 17 October 2006.

It was written by Peter Edwards, Manager, Investigations and Complaints Management Workforce Standards and Performance Unit.

"3. There have been several investigations into allegations raised by (my name) ..."

 

This is not correct.

There has been one investigation.

And even that was not what any normal person would call an "investigation".

 

3 November 2000

I asked Lynch-Mob State School acting principal Mrs GR to support me in dealing with the unsupervised groups of Grade 7 students who were missing from their classrooms, roaming about the school, disturbing the other classes.

I had already discussed this problem with Lynch-Mob State College usual principal Mr EL during Term 3.

He told me that several other teachers had complained to him about the constant disruption to their classes.

He then spoke at a staff meeting, asking teachers not to send so many children roaming around the school on "messages".

 

29 November 2000

Mrs GR gave me a letter to advise me that she and usual principal Mr EL had agreed that "the (DWP) process is warranted" and that I would be on Diminished Workplace Performance (Now called MUP) in 2001.

This letter seems to provide documentary evidence of Lynch-Mob State School acting principal Mrs GR and usual principal Mr EL's abuse of the Diminished Work Performance Process.

A copy of this 29 November 2000 letter can be seen in 2421 File F - the "private file" of real and falsified "records" concerning me that Mrs GR claims to have been secretly collecting during Term 4 2000.

It is Document 59, using the numbers at the top right hand corner of the document.

It is also in 2469 File F - the Stage I Grievance file of real and falsified "records" concerning me that Mr EL seems to have sent to the District Office after my retirement.

This created the falsified impression that these falsified "records" had been shown to me and discussed with me before Mr EL dismissed my Stage 1 Grievance about Mrs GR's abuse of the DWP process.

Lynch-Mob State College usual principal Mr EL and acting principal Mrs GR seemed to be "paying me back" for asking Mrs GR to support me in dealing with the roaming groups of Grade 7 students.

 

13 December 2000

I asked the District Director to appoint an officer to investigate their behaviour and to determine the truth.

A copy of my letter to the District Director is on record at 2469 File B The District Office document 104, number at the top right hand corner of the document.

 

During 2004 an Aboriginal employee of Education Queensland with no qualifications in Education, Law or Psychology conducted an "internal review".

This "Internal Review" was based on the mass of falsifed "records" that had been secretly placed on my official Education Queensland files.

The "Internal Review" only began after I had made a Freedom of Information application and it became obvious that I was going to find the mass of falsified documents.

The falsifed "records" were not released to me till several months after the "Internal Review" began.

 

Mrs GR seems to have been "recording" imaginary conversations which she was having with children, parents, teachers, other principals and District Office staff concerning me.

Mrs GR's "records" are falsified in many other ways.

For example, real events have been falsified out of the "records".

And sometimes Mrs GR "recorded" two alternative versions of "why I did it".

 

My responses to these falsifed documents were "not considered" by the "Internal Reviewer".

 

You may find this a ridiculous way to conduct a "Review".

I certainly did.

 

I asked for the abuse of the Education Queensland Diminished Workplace Performance Process and the Grievance Process to be properly investigated.

 

In late 2005 Education Queensland employed "Verifact Investigations" to conduct an "external investigation".

The investigation took till July 2006 to complete.

 

"4. Verifact found that Lynch-Mob State School Acting Principal Mrs GR had kept some notes on ... (my name).

(My name) had not previously seen these detrimental records.

Mrs GR later provided them to FOI who in turn provided them to (my name)."

This is correct.

And for this conduct alone the Verifact Investigator recommended that Disciplinary Action be considered.

 

But this is not the whole story.

 

I discovered after June 12 2008, two years after the Verifact Investigation had been completed, that Mrs GR and Mr EL had introduced significant changes to their "story":

 

1) The 63 2421 File F documents were described as "Lynch-Mob State School documents" when some of them were released to me for the first time after 27 April 2004.

And on 23 March 2004, Stephannie Kalas, Acting FOI Co-ordinator, Administrative Law Services Unit, Education Queensland, had refused to provide me with copies of all but 4 documents in 2421 File F because, she advised me, all of the other 2421 F documents

"... deal with the grievance process you were involved with ...".

But in 2006 Lynch-Mob State College acting principal Mrs GR changed her story.

She told the Verifact Investigator that she had actually kept this file of 2321 F falsified records in her own possession.

 

But -

 

2421 F was not the only file of falsifed "records".

 

2) After 12 July 2004 another file of falsified "records" described as "2469 File F The District Office" had been released to me.

This file contained 146 documents, about half of them falsified.

Lynch-Mob State School acting principal Mrs GR had given a file of her falsified "records" to Mr EL.

And Mrs GR had hand-written more falsified messages to Lynch-Mob State school usual principal Mr EL on several of her falsified 2421 documents.

Mr EL had written on one of the falsified documents himself.

This file was called 2469 File F "The District Office Documents".

 

  • The two files - 2421 and 2469 - held different versions of the falsified documents.

 

But after 12 June 2008 I discovered that the Education Queensland / Mrs GR and Mr EL story had been changed.

Now a new document dated 5 February 2004 had appeared on my file.

The following words have been written by hand on a scrap of paper-

 

"5 February 2004

Dear Stephannie (Kalas- the Education Queensland FOI officer),

 

Please check out what may be relevant in the attached file.

Copies of these were also filed at Lynch-Mob State College.

 

Lynch-Mob State School acting principal, Mrs GR"

 

So, if we accept that this document that appeared for the first time after 12 June 2008 is a genuine document, it suggests that Mrs GR not only had -

 

  • a 2421 F file of 63 falsified "records" concerning me that she was storing at home,

 

  • but she had also filed another set of falsified documents at Lynch-Mob State School, on which she had written notes to Lynch-Mob State School usual principal Mr EL.

 

  • and that Mr EL had written notes on one of the falsified documents himself,

 

  • then he had placed the mass of falsified documents in the 2469 F file that contained the records of his January - February 2001 investigation into my Stage 1 Grievance about Mrs GR's (and his own)  abuse of the Diminished Work Performance process.

 

  • And then he had noted in his 5 February 2001 Stage 1 Grievance Investigation Report"-

 

"On the matter of the Grievance all paperwork was received ..."

This File 2469 F is the Stage 1 Grievance File that Lynch-Mob State College usual principal Mr EL seems to have sent to the District Office a few days after my retirement on July 9 2002.

This created the false impression that the mass of falsified "records" in this file 2469 F had been discussed with me during the investigation into my Stage 1 Grievance about Mrs GR's abuse of the DWP process.

And that I had been given the opportunity to point out that many of Mrs GR's "records" had been significantly falsified.

 

"8. ... the WSPU will be closing the matter and will not enter into any more correspondence on all matters previously investigated. ..."

"9. It is recommended that the Department continue a "Nil Response Required" approach in all matters previously investigated, raised by (my name)."

But the Verifact Investigator seems to have only been allowed to establish that the falsifed documents were placed on my Education Queensland files without my knowledge.

He did not investigate the actual falsification of the "records".

And he seems to have been instructed to copy down exactly what Lynch-Mob States School acting principal Mrs GR, usual principal Mr EL and acting deputy principal Miss AL told him, even if it was obviously untrue.

 

In tiny-weeny writing at the very top of his investigation report, the investigator has written:

 

"The witness based information contained within this report is soley sourced from interviews.

No conclusions are drawn in this report as to the veracity of such information."

You might think that this is a very strange sort of "investigation".

You might think that this Education Queensland process of simply copying down yet more malicious, unsubstantiated gossip encourages and facilitates the abuse of Queensland teachers.

I certainly do.

 

At what stage of this process will Education Queensland actually investigate the falsification of my "records"?

 

I have described the falsifification of my records in many emails to Ken Smith.

On Monday 21 June 2004 at 12:35 I emailed Ken Smith and copied the email to the CMC, the Ombudsman, MailBox@justice.qld.gov.au

The email was headed:

 

"Please act to protect children and teachers from principals who are suffering from mental health problems."

 

I attached a letter to Ken Smith and my responses to five of the falsified documents that I had found in 2421 File F - Ms GR's "private file" of real and falsified "records" concerning me.

At 12:45 PM the next day I handed in at the front desk of the Cairns District Office a printed copy of my letter to Ken Smith and my responses to the five falsified documents

I emailed the Director-General at 3:37 PM that day to advise him of the name of the person in the Cairns District Office to whom I had handed the printed copy of the letter to him amd the documents.

 

I later discovered under FOI that all copies - both printed and emailed - of my letter to Ken Smith and my responses to the falsified documents had simply been "lost".

My Education Queensland "records" have been extensively falsified and I would like this investigated.

 

  • The falsified "records" were not shown to me or discussed with me by either Mrs GR or Mr EL before they made their 29 November 2000 agreement that "the (DWP) process is warranted".

 

  • They were not shown to me or discussed with before Mr EL dismissed my Stage 1 Grievance about the abuse of the DWP process.

 

This is my complaint.

This is what I want investigated.

This is what Education Queensland officers have been refusing to investigate since 2000.

This refusal to investigate my complaint, - this continual side-stepping of the falsification of my official records - is systemic abuse.

This is what I first complained about to Jim Varghese, the Director-General on 31 August 2001.

This abuse of the "investigation" process has substantiated my complaint that the Education Queensland DWP (now called Managing Unsatisfactory Performance) and Grievance processes are being abused - to this day, 25 February 2009 - to drive Queensland classroom teachers into ill health and out of work.

I recommend to you that you investigate the abuse of

by senior officers of Education Queensland.

 

I suggest to you that the abuse of these two processes by senior officers of Education Queensland is encouraging Queensland school principals to abuse the MUP and Grievance policies and to drive good Queensland classroom teachers into ill health and out of work.

 

Peter Edwards' General Briefing Note was signed by "The Director" on 23 October 2006.

The Director's name is obscured but I presume that it was signed by Regan Neumann, who was Director of Ethical Conduct at the time.

And it was signed by Gary Barnes, Assistant Director-General on 25 October 2006.

And it was signed by Rachel Hunter, Director-General on 30 October 2006.

 

 

Education Queensland General Briefing Note dated 14 July 2006.

This General Briefing Note was written by Robyn Martin, Director, Legal and Administrative Law Branch, Education Queensland.

A copy of this General Briefing Note was first released to me after 9 January 2009, attached to a letter from the Education Queensland FOI officers.

 

During 2004 I had discovered a huge mass of falsified "records" in my official Education Queensland Files.

Real events had been falsified out of these "records".

The "records" of other events seemed to have been significantly falsified.

Many seemed to be "records" of imaginary conversations concerning me that Lynch-Mob State College acting principal Mrs GR claimed to believe that she was having with children, parents, teachers, other principals, the local QTU organiser and at least one member of the District Office staff.

 

During late 2004 a principal and a member of the District Office staff told an Infocomm Officer that they had not had the conversations with Lynch-Mob State College acting principal Mrs GR that Mrs GR had "recorded' and placed secretly on my file.

 

In 2006  a Verifact investigator was appointed to investigate my complaint that my official Education Queensland records had been extensively falsified.

 

28 November, 2000.

Lynch-Mob State College acting principal Mrs GR claimed, in secret "records" that she scribbled on loose scraps of paper, that she had discused me with a student, a mother and, a few days later, a father.

2469 File F The District Office, documents 20, 21, 22 and 26. This is the file of documents used during my Stage 1 Grievance about the abuse of the DWP process.

Lynch-Mob State School usual principal Mr EL seems to have sent Mrs GR's file of falsified "records" concerning me to the District Office when I retired.

This created the false impression that these "records" of Mrs GR's imaginary conversations concerning me had been discussed with me during my Stage 1 Grievance about Mrs GR's abuse (and, I now realise, Mr EL's abuse) of the DWP process.

 

February 9, 2006

On February 9, 2006 I phoned the father with whom Mrs GR had what now seems to have been an imaginary conversation on 1st December, 2000.

Mrs GR's "record" of that imaginary conversation can be found on 2469 file F The District office document - at the bottom of the main text, after "NB"

 

The father told me that no principal of Lynch-Mob State College had ever made any such phone call to him.

 

February 11 2006

Mrs GR also had what seems to have been imaginary conversations with a mother and a child on 28 November, 2000, the day before she and Lynch-Mob State School usual principal Mr EL made their agreement that I would be on DWP in 2001.

I phoned this child.

He had grown up, and was now a UNI student.

 

He also told me that he had never had any such conversation with Mrs GR.

 

But, the student told me,  one term before, when Mr EL was principal, he had told Mr EL about an eraser that had been thrown at him.

The student suggested to me that Mr EL had told Mrs GR about this eraser-throwing incident.

 

One eraser had been thrown at this student, once.

Mrs GR's "records" of her imaginary conversation state -

 

"Complained about ------ thowing yellow tak & bits of rubber at him before LOTE (Indonesian)."

 

As her own "record" states that this imaginary eraser attack occured before LOTE I do not know why Mrs GR placed this "record" of the incident on my file.

I know nothing about this incident.

It was not discussed with me before Mrs GR and Mr EL made their 29 November 2000 agreement that "the (DWP) process is warranted".

It was not discussed with me before it was secretly placed on my official Education Queensland files.

The whole "record" seems to be a falsification.

The Verifact Investigator had asked me to send all of my emails to his Brisbane Head Office.

I was worried that he might not be receiving my emails.

 

"I am beginning to wonder if some of the notes on my file eg. the conversation with the child (I named the child), were simply made up.

And if these documents really did exist in 2000, why weren't they shown to me before I was put on Diminished Workplace Performance or before my Stage 1 Grievance about the abuse was dismissed? ..."

 

I attached the notes I had made on my phone conversations with "Desley", the father and the student.

The Verifact Investigator interviewed Mrs GR.

 

29 April 2006

Lynch-Mob State College acting principal Mrs GR wrote to "you" (presumably Ken Smith, the Director-General) expressing her concerns about what she described as - concealed by FOI officers s.44 (1)- "

 

Mrs GR seems to have complained to Ken Smith, about the Verifact investigation into the falsified collection of "records" that she had secretly placed on my Departmental file. 

And Mrs GR also seems to have complained to Ken Smith because I was making FOI applications for the "Notes to Leigh from Desley".

Mrs GR had claimed that "Desley" had made allegations against me in these notes to Leigh.

And that Desley's allegations had triggered the deeply offensive and unprofessional statements that Mrs GR had made to the staff concerning me during the Lynch-Mob State College Staff Meeting on the morning of 10 November 2000.

I had requested a mediated meeting with Mrs GR to discuss Mrs GR's seemingly irrational behaviour during the staff meeting on 10 November 2000.

Mrs GR seems to have complained to Ken Smith because I had applied for the "lots of pieces of paper" that contained the "lot of allegations" that Mrs GR had described during the mediated meeting on 27 November 2000.

Mrs GR's statement concerning these "lot of allegations" was recorded by Miss AL and placed on my Departmental file.

 

17 May 2006

The Verifact Investigator spoke to Peter Edwards  concerning Mr Edwards' pending briefing of ADG (Assistant Director General). 

To complete the Briefing to the ADG, Peter Edwards required certain details within the Verifact Investigator's preliminary report. 

This suggests to me that Robyn Martin's Briefing may actually have been written by Peter Edwards, or based on a Briefing written by Peter Edwards.

The Verifact "independent" investigation into my Public Interest Disclosure concerning the systemic abuse of the Education Queensland Diminished Work Performance policy and the Grievance policy to bully Queensland teachers into ill health and out of work was completed.

 

  • This "independent" investigation was very tightly controlled by Education Queensland senior officers at every stage.

 

  • The "independent investigator" seems to have been instructed to copy down exactly what he was told by Lynch-Mob State College usual principal Mr EL, acting principal Mrs GR and acting deputy principal Miss AL, even though it must have been obvious to him that some statements were untrue.

"Background

1. On 29 April 2006 Lynch-Mob State College acting principal Mrs GR wrote to you (presumably Ken Smith, the Director-General) expressing her concerns about what she described as - concealed by FOI officers s.44 (1)- "

 

Mrs GR seems to have complained about my FOI applications.

There was such a huge mass of falsified "records" and they were being released to me so reluctantly, that I had to make several FOI applications.

 

  • To this day, 13 February 2009, I am still waiting to receive documents that I first applied for in September 2003.

 

What Robyn Martin may not have realised was that there was a series of political relationships that were affecting my case.

I disclosed these political relationships to the Queensland Information Commissioner on 19 December 2004, 24 January 2005 and again on 1 February 2009 by email at 12:42 PM.

Ken Smith must have been aware of at least some aspects of this political situation.

 

Of course, Lynch-Mob State College acting principal Mrs GR would have been fully aware of these political relationships when she wrote to Ken Smith.

Mrs GR would have understood the political relationships a great deal better than me.

My Public Interest Disclosure

  • by letter to the Director General on 31 August 2001

 

  • and again, in person, to Anna Bligh and Jim Varghese on 23 June, 2002,

was that -

The Education Queensland Diminished Workplace Performance Policy and the Education Queensland Grievance policy were being abused to bully Queensland teachers into ill health and out of work.

 

My own experience demonstrates the systemic nature of the abuse of Queensland teachers.

A malicious principal can take nothing at all and turn it into a reason to punish a teacher.

And Senior Education Queensland officers seem to negligently / passively facilitate this bullying.

 

"4.  (My name) continues to hold the view that she was unfairly treated by the Department in relation to her workplace relations with ... fellow teachers ..."

 

The only people with the guts and integrity to speak out about the bullying were seven classroom teachers who had actually seen me teach for periods of up to two years.

They told Mrs GR, who had not been into my classroom or looked at my program for twelve months, that there was no problem with my work.

They told Mrs GR very, very clearly and firmly that she was making a mistake.

They amazed each other by how clearly and firmly they spoke to Mrs GR.

 

They were ignored.

Their support for me has been falsified out of the official records.

No, this is not true.

I am very grateful that I was allowed to retire on the grounds of ill health.

Dealing with Mrs GR's seemingly irrational and impulsive behaviour had affected my health.

 

(Other people's health problems are so boring, but Mrs GR seems to be claiming that my FOI applications for the falsified "records" are stressing her, so I will try to explain briefly how Mrs GR's seemingly irrational and impulsive behaviour affected my own health.)

Since late 1999, possibly earlier, I had been suffering from a lot of problems with my heart - continual thumping and banging of different types, pains from both sides of my heart.

After the shock of Mrs GR's seemingly irrational statements concerning me to the staff on 10 November 2000, I was very ill.

I felt "jittery" and unable to think clearly.

I was thinking very, very slowly.

I spent many hours crying.

I developed continual tinnitus - a loud roaring noise in my right ear.

For the rest of the term I just wanted to remain as calm as possible and to do nothing that might justify another attack by Mrs GR.

I was walking about the school in a daze.

I went to Bali for a month during the holidays.

The tinnitus continued.

Walking into Ubud one day, I fell over.

There seemed to be no reason to fall.

I had the "black cloud" sensation that you get when you fall, and I waited for it to pass.

But it didn't pass.

I had the feeling that the parts of my brain had lost contact with each other and I could not get them joined together to work properly again.

My knee was also bleeding badly so, fortunately, a wonderful young American man came to my aid and drove me back to my hotel.

I was having difficulty thinking and communicating.

By the time I arrived home to Australia, I was in a lot of pain and struggling to stand up.

Once I arrived home and had access to good medicine, my knee began to heal.

But I began to feel dizzy when I stood at the side of roads.

This problem of "dizziness" has continued for several years, in different ways.

Sometimes worse, sometimes not so bad.

At times a great deal of my mental energy was being used to just to walk without falling over.

About two years ago the "dizziness" seemed to improve.

But still I notice that if I walk around a table or an enclosed area a few times, I begin to feel "zapped out".

And sometimes I feel disorientated.

I did not have this "dizziness" before I was bullied.

I am quite certain that it was caused by the bullying.

The problems with my heart were instantly cured when I was given my first one-month sick leave form.

It was then that I realised that the problems with my heart had been caused by the stress of the bullying and the lack of support for my work.

In the eight years since I left Lynch-Mob State College, I have never had any problem with my heart again.

So -

When I was told that I had a hearing loss, my choices were -

 

a) To have an operation on my ear.

There was a one-in-twenty chance that the operation would send me stone deaf with no chance of ever hearing again.

There was also a risk of side-effects like facial paralysis, the tinnitus becoming worse, etc.

And then, after the operation, returning to work and having to deal with the malice and what seemed to be the systemic corruption.

I wondered how ill I would be after the operation.

Would I be able to do my job properly?

Sometimes it felt as if most of my brain-power was being consumed by the effort to walk upright.

It would be hard for me to look after a class of children at those times.

The problems with my heart would certainly begin again.

I feel confident that I would have had a heart attack fairly soon after returning to work with Mrs GR.

I would be on Diminished Workplace Performance (DWP - it is now called Managing Unsatisfactory Performance), trapped at the mercy of these seemingly irrational and abusive administrators.

I would be continually afraid that any trivial incident could be "beaten up" into an excuse to abuse me and drive me out of work.

The Queensland Teachers' Union organiser had told me that there was no hope of justice.

That the DWP process could last for as long as two years and that people were usually mentally and / or physically broken by the process.

14 July 2006

An un-named Assistant Director-General signed the General briefing Note.

Ken Smith, Director General read and initialled the General Briefing Note.

He wrote:

 

"I would like to ring Lynch-Mob State College acting principal Mrs GR to discuss.

I would also like to discuss with Robyn - Lynch-Mob State College acting principal Mrs GR's comments about being "stalked by process" have some veracity.

What can I do."

 

  • Mrs GR claims, in her falsified "records", that she first told the District Office staff that she wanted to put me on DWP on the sixth day that she was acting principal. If this is true - and who would know - the District Office staff, knowing that Mrs GR was very inexperienced, simply abandoned me to her abuse.

 

  • Several weeks later, Mrs GR's total knowledge of the DWP process was contained on one small square sticky-note.

  • I worked part-time for eight years to earn two good degrees but Education Queensland allowed Lynch-Mob acting principal Mrs GR to destroy my health and my career with a sticky-note full of knowledge.

 

  • The senior officer who dictated that sticky-note-full of information to Mrs GR must have realised that Mrs GR had no knowledge of the DWP policy.

 

  • But I was just abandoned to Mrs GR's incompetence, malice and abuse.

 

  • This was systemic negligence.

"I met with Lynch-Mob State College Acting Principal Mrs GR and (District Director who had a political relationship with acting principal Mrs GR) at (name of school that Lynch-Mob State College acting principal was promoted to a few days after I had been repeatedly assured that the bullying was under control) on Wednesday 26 July.

Subject to the independent investigation undertaking Lynch-Mob State College acting principal Mrs GR is not to be contacted with respect to any issues raised by (my name).

I will not subject her to any more stress on this matter ..."

 

But Mr Smith, you are the husband of the Information Commissioner!

Are you instructing your staff to block my FOI applications?

 

And what about my stress, waiting since September 2003 for these documents?

And where was your concern when I was being bullied?

 

Where is your concern for the 99.8% of teachers who told UNE researchers that they had been bullied at work?

Mr Smith, The Verifact Investigator spoke to Mrs GR on 7 March, 2006.

He recommended that disciplinary action be considered.

Did you really not know this on July 26 2006, more than three months later?

 

This explains why my FOI applications have been delayed for years.

On 17 September 2007, fourteen months later, Anna Bligh announced that there would be an independent overhaul of Queensland's Freedom of Information laws.

And Cathi Taylor, Ken Smith's wife, resigned as Information Commissioner.

  • This document seems to have been a significant document in the history of my "case".

 

  • Many later decisions concerning me seem to have been based on the information contained in this document.

 

I first responded to this Briefing Note to the Education Queensland "Internal Reviewer" on 2 August 2004 at 4:53.

The Education Queensland "Internal Reviewer" seems to have chosen / been directed to "not consider" my response to this Briefing Note in writing his "Internal Review".

I emailed a copy of my response on 3 August 2004 at 9:29 to Ken Smith, the Ombudsman and the Crime and Misconduct Commission (CMC).

I emailed a copy of my response to John Ryan on 3 August 2004 at 10:44.

 

  • My response to this Briefing Note seems to have been ignored to this date, 14 February, 2009.

 

"Subject: (MY NAME)'S CORRESPONENCE RE: GRIEVANCE AND WORKPLACE BULLYING ...

3. As 15 December 2000 was the last day of the school year the complaint was forwarded to Lynch-Mob State College usual principal, Mr EL, to be investigated at the beginning of the school year as a stage 1 Grievance."

 

NOT QUITE TRUE

The day after receiving my Grievance, District Officer CHR faxed it to Lynch-Mob State College acting principal Ms GR, the person whose abuse I had complained about.

Ms CHR also faxed Mrs GR a letter to give to me.

In this letter District Officer CHR advised me that, "Mrs GR will contact you in relation to this."

Mrs GR called me into her office and showed me District Officer CHR's letter.

A copy of this letter can be found at 2469 File G Human Resource Services Branch, document 155

 

"4. (My name)'s Grievance centred on a claim of Mrs GR's harsh, unjust and unreasonable treatment of (my name) in Mrs GR's role as Acting-Principal in response to Mrs GR's consideration of a Diminished Work Performance Process with (my name)."

MUDDLED

My Grievance was that Mrs GR had abused the Diminished Workplace Performance (DWP) Process (now called the Managing Unsatisfactory Performance (MUP) Process) to "pay me back" for discussing the number of interruptions to my Indonesian  lessons.

Many students were missing from the Grade 7 classrooms when I arrived to take Indonesian lessons.

When I was teaching other classes, roaming groups of unsupervised Grade 7 children would disturb my lessons.

I had been warned by another teacher that Mrs GR was "out to get" me.

I asked for a mediated meeting with Mrs GR to discuss the problem.

My Grievance was that Mrs GR had abused the DWP process as a red-herring in order to avoid the mediated meeting that I had requested.

 

" ... in response to Mrs GR's consideration of a Diminished Workplace Performance process."

MISLEADING

I notice that Education Queensland officers are now trying to construct an argument that Mrs GR did not officially put me on the DWP.

But the DECISION had been made that I would be on DWP.

On 29 November 2000 Mrs GR had written to me to inform me that the DWP process would be instigated at the commencement of 2001.

Ms Mauger's letter to me stated that-

"I have spoken with him (Lynch-Mob State College usual principal Mr EL) about the matter and he is in agreement that the process is warranted."

A copy of Mrs GR's 29 November 2000 letter to me can be found at 2421 File F Lynch-Mob State College document 59, number at top right hand corner of document.

 

Lynch-Mob State College usual principal Mr EL had made this agreement that the DWP process was warranted without discussing the situation with me.

This was a further act of injustice.

 

"5. In his report of 5 February, Lynch-Mob State College usual principal Mr EL found that the grievance was not supported."

BUT

  • Mr EL had edited the reason for my Grievance out of his report.

 

  • Mr EL had refused to talk to the seven Grade 5 and 6 teachers who had seen me teach for periods of up to two years and who all supported me. They had a formal meeting with Mrs GR and told her very, very clearly that she was making a mistake and that there was no problem with my work. Mrs GR had not been into my classroom or looked at my program for the past twelve months. Lynch-Mob State School acting deputy principal AL had never, ever seen me teach.

 

  • And the Queensland Teachers' Union rep told me that Mr EL had "put a spin" on his own words to distort their meaning.

  • Mr EL did not show me or discuss with me the huge mass of falsified "records" that Mrs GR had given to him.

 

  • He did not show me or discuss with me the many comments that she had scribbled on these "records" to falsify them even further.

 

  • But Mr EL seems to have received these documents, because he reported

"On the matter of the Grievance all paperwork was received ..."

  • And Mr EL's  own handwritten notes can be seen on the left hand side of acting deputy principal Miss AL's notes on the meeting on 12 October 2000.

  • These notes were never shown to me or dicsussed with me by either Mrs GR, Miss AL or Mr EL himself.

 

"7. The District Office accepted the stage 2 Grievance after the Principal Personnel Officer, District Officer Mrs GN, received advice from the Employee Relations Unit on timelines and any changes in the nature of (my name's) grievance on 19 October 2001. ..."

 

BUT

My Grievance was a systemic Grievance.

It was probably a Public Interest Disclosure.

 

Preventing and Resolving Grievances 21/07/2000 states-

"Some grievances may still be directed to the Assistant Director Human Resources. these include ... issues that are systemic in nature, that is arising out of centrally developed policies."

 

I had decided to make a systemic Grievance because I knew that there would be no hope of justice if I made a Grievance about Mrs GR's bullying to The District Office.

The cover letter that I sent to the Director-General with my Grievance made it clear that I would not get an impartial hearing in The District Office.

The Director-General sent the systemic grievance to Principal Personnel Officer, District Office, Mrs GN.

 

On 18 October 2001 at 6:14 I emailed Peter Milton, Senior Industrial officer, Education Queensland Head Office:

"I have just received the letter from the Director-General.

My complaint was about the systemic abuse of the Grievance process to bully and intimidate teachers.

One of the people that I named in the grievance was Principal Personnel officer, District Office, Mrs GN.

The grievance has been sent to her.

I find this inappropriate.

This is the sort of thing that my grievance was about.

I made it plain in my grievance that I did not believe that I would get an impartil hearing at District level.

Who is responsible for this decision?

Would you please make sure that the Director-General is fully aware of this situation."

 

and at 10:17 I emailed Peter Milton again:

"Peter, I believe that the handling of my grievance has been seriously inappropriate.

I would like to discuss the situation with the CJC (now called Crime and Misconduct Commission - CMC) liaison person.

Please advise me on how to contact this officer."

 

On 19 October 2001 I rang a junior employee of Education Queensland Head Office and discussed my concern that the Principal Personnel Officer, District Office, Mrs GN seemed to have been involved in the bullying.

Mrs GR had often told me that she was consulting with "her superiors in the Department" and acting under their instruction.

Mrs GR had named Principal Personnel Officer, District Office, Mrs GN as a person who was advising her on her abuse of the DWP.

 

The junior Head Office employee emailed Peta Alfredson to discuss my concern.

Peta sent the email to Peter Milton.

Peter Milton sent it directly to Principal Personnel Officer, The District Office, Mrs GN.

So all of these Education Queensland employees knew that I was concerned that The Principal Personnel Officer, District Office, Mrs GN had a conflict of interest in dealing with my Grievance.

...

"10. (My name) discussed her issues with Ms Katrina Jefferson, Legal and Executive Unit during November 2001 to ascertain whether her complaint could be a matter of official misconduct or Public Interest Disclosure.

The advice was that the matter should be investigated through the Grievance system.

11. (My name) informed Ms CHR of this on 25 January 2002."

 

BUT

I had been advised that if the systemic Grievance was not accepted as a Public Interest Disclosure I would have to change the Stage 2 systemic Grievance to  a Stage 1 systemic Grievance to Education Queensland Head Office.

I was trying to contact the investigating officer to come to an agreement about withdrawing my Stage 1 systemic Grievance to Education Queensland Head Office.

  • I wanted my 31 August 2001 Stage 2 Grievance to be placed on my personnel file at the District Office as a response to Lynch-Mob State College usual principal Mr EL's February 5 2001 "Report".

 

I emailed Education Queensland head Office repeatedly, asking the investigator to contact me.

The following chain of emails demonstrates that Principal Personnel Officer, District Office, Mrs GN, and many other officers in Education Queensland Head office were aware that I was making repeated efforts to contact the investigating officer:

 

On Monday 3 December 2001 7:10 : I emailed HumanResources@qed.qld.gov.au Subject: Attention Paul Leitch.

"Dear Mr Leitch,

On 31 August I mailed a grievance to the Director-General concerning workplace bullying.

The CJC liaison officer has been examining the grievance during the past few weeks.

She has advised me that it should be dealt with as a grievance. ...

I will be unavailable till January 10 so I would be happy if the 21 day period of the enquiry commenced on that date.

Hopefully this would mean that the Stage 1 enquiry should be complete by 31 January."

On January 24th 2002 I emailed District Officer Ms CHR:

"Ms CHR, do you have any idea who is dealing with this now?

I have sent several emails to Brisbane and cannot get any response."

 

Mrs CHR's response indicated that she knew nothing of what had happened since 7th November 2002:

"Have contacted EQ's Liaison Officer to the CJC (CMC) to check as you may remember on 7 November you agreed to send documents to Katrina Jefferson.

Will get back when I have a reply."

 

Because District Officer CHR appeared to be genuinely ignorant of recent events in my case, I attempted to update her in an email dated 25 January 2002.

meanwhile, I continued to try to make contact with the investigating officer.

My object in contacting District Office Employee Ms CHR had been to find out who was the investigating officer.

 

 On 9 February 2002 at 1:40 I emailed HumanResources@qed.qld.gov.au again:

"I would appreciate it if the officer investigating this issues would contact me."

 

On 11 February 2002 Kerri Klisanin emailed me:

"Sorry to learn that you have not received a reply to your enquiries as yet.

I have forwarded your message with High Importance to the Employee Relations Unit ..."

 

On 13 February 2002 at 9:47 I emailed Kerri Klisanin:

"Re: Attention Paul Leitch ...

I would like to know which officer is dealing with the issue and to be sure that my response to Lynch-Mob State College usual principal Mr EL's report is on my personal file."

 

On 13 February 2002 at 12:43 Kerri Klisanin emailed me:

"... I do not possess the expertise to respond and am forwarding to a more appropriate officer in The District Office (whom I believe you have spoken with personally over the course of your communications).

Please direct all further correspondence to this officer and not myself ..."

 

and she emailed the Principal Personnel Officer, District Office, at the same time:

"Hi (name of PPO),

To reiterate Peter's email to you on Monday of this week -  is (my name)'s latest email consistent with your understanding of what's happening?

We wondered if your District Office could phone her & advise that central office doesn't appear to have any current involvement in her concerns."

 

Kerri also sent a copy of this email to me.

I was bewildered.

I had been advised that I needed to make  Stage 1 Grievance to Education Queensland Head office.

I had done that.

But they would not accept it.

I could not seem to penetrate their determination not to deal with my Grievance.

 

On 13 February at 1:28 I emailed Kerri Klisanin:

"Dear Kerri,

Who is this person in the Cairns office that I should contact?

Please look back through the emails.

The person was never identified."

 

Finally, on 13 February 2002 at 1:45 PM I emailed Katrina Jefferson myself to ask her if she had any idea who was handling my case:

"I have sent several emails to head office asking which officer is dealing with my grievance now.

I had no reply till today.

They say that somebody in The District office is dealing with it.

They do not say who.

District Office Employee mrs CHR knew nothing about it two weeks ago. ...

Have you any idea who is handling it?

I am wondering if I should begin again and re-submit it as a Grievance as there seems to be no other way of communicating with Education  Queensland."

...

"12. District Officer Ms CHR asked (my name) on 14 February 2002 if District officer Ms CHR was to understand that (my name) felt that the Grievance had been resolved."

 

TRUE.

When I received this email, I presumed that District Officer Ms CHR herself must be the investigator.

I wondered why the investigator knew so little about the investigation.

And I became less confident that Education Queensland was dealing effectively with my grievance.

I replied:

"Have the new Departmental policies been formalised yet?

I am wondering if it would be possible for me to have a link to them so that I can read them, or attend one of the re-training courses.

I think I need to be sure that things are going to be safer for teachers in Queensland.

Then I will feel that my experience had a positive outcome."

 

On 25 February 2002 at 9:41 AM I emailed District Officer Ms CHR again:

"It is now five months since I sent in my report and I am hoping that some progress at state and local level has been made in taking action to deal with workplace bullying.

This is a systemic issue and really should have been dealy with by Head office.

Has dealing with it at the local level worked well?

What progress has been made at the local level to deal with the issues raised in the report?"

...

District Officer CHR had stated in her 14 February 2002 email to me :

Dear (my name)

I realise that I have not indicated to you that the grievance and support documents have been placed on your personal file as a matter of course.

This being so, can I now understand that ... you feel that the grievance has been resolved?"

 

Notice the tricky wording here.

I thought that I was being told that my response to Mr EL's "report" had been put on my personal file.

But no.

  • I was being told that it hadn't been put on my personal file.

 

I began to realise that I had been tricked on 27 May 2002, when I received an email from the Staff Welfare Officer:

 

"At this office we hold two files for you: your 'general personnel file' (that you can see with an appointment at any time, and photocopy anything out of it),

and a confidential file with documentation pertaining to the investigation that took place last year.

This file is available for you to see under FOI (Freedom of Information), and yes, holds any response you might have made in this process.

This file will continue to be kept under lock in District Officer Ms CHR's room."

 

So my Stage 2 systemic Grievance was locked in Ms CHR's room under FOI.

And the FOI application process would take months and even years.

On 27 May 2002 I began to feel that I had been significantly tricked by District Officer Ms CHR.

...

 

"13. During March 2002 Principal Personnel officer , District office, Mrs GN, and District Officer Ms CHR informed (my name) of the contact persons in Education Queensland who were involved in writing policy in the area of workplace bullying."

SORT OF TRUE BUT USELESS

25 February 2002 - District Officer Ms CHR emailed me to give me the phone number of Rebecca Michael.

I phoned Rebecca Michael to express my interest in being actively involved in the development of the policy on workplace bullying.

At 4:15 PM I emailed Rebecca Michael to confirm the call.

4 March 2002 Rebecca Michael responded:

"email received"

This was the only response that Rebecca ever made.

24 March 2002 I emailed Rebecca Michael to ask if I could be involved in reviewing the policy before it was formalised.

No response.

27 March 2002 Principal Personnel Officer, District office, Mrs GN, emailed me to suggest that I contact the Queensland Teachers' Union (QTU) if I wanted to have input into the consultative process.

But the QTU did not represent my interests.

The QTU advised teachers that there was no hope of justice if you were bullied.

The QTU seem to have a conflict of interest.

They represent both the interests of administrative bullies and of bullied classroom teachers.

You might think that this is a bully-friendly situation.

No consulative group that represented the interests of classroom teachers 100% (especially the views of those classroom teachers who did not agree to be bullied) was involved in the development of the workplace bullying policy.

...

"13 (My name) met with the District Director and Principal Personnel Officer, District Officer, Mrs GN, on 9 July 2002.

At this meeting (my name) indicated that she was satisfied that schools were being monitored regarding bullying by the District Staff."

MUDDLED

I respected and trusted the District Director absolutely.

I did not beleve that the District Director had been involved in the bullying.

I regarded his wife as my friend.

I had spent many Sundays organising groups to work in the local community for his wife.

I did not believe that the District Director would lie to me.

I asked the District Director if he had the bullying under control.

He said that he was reasonably sure that he had.

I accepted his word.

he was the District Director.

I simply could not imagine that a District Director would lie.

Later during the meeting I asked the District Director to re-state that he had got the bullying uder control.

He did so.

I was greatly relieved.

I believed that the District Director had the bullying under control.

And that the abusive experience was finally over.

 

But I had been tricked.

I had not been told that-

  • Mrs GR was going to be given a big promotion opportunity - to be acting principal of a large local school - a couple of days after my meeting with the District Director. And six months later this big promotion was going to be "confirmed".

 

  • Mr EL had a huge, secret mass of Mrs GR's falsified "records" of imaginary conversations concerning me with children, parents, teachers, principals, the local QTU organiser and District Office staff.

 

  • And that, a couple of days after my meeting with the District Director, Mr EL was going to send this mass of falsified "records" to be secretly placed on my Education Queensland files in the District Office.

 

  • Mrs GR had another secret file of 63 real and imaginary "records", some of which contradicted the falsified "records" that she had given Mr EL.

 

  • Reality - real evidence supportive of my complaint - had been "edited out" of Mrs GR's secret "records". So a totally false impression of me and of my complaint was going to be created on the files held at the District Office.

He was Assistant Director-General, Shared Services, responsible for the oversight of facilities services, finance services, human resource services, information management, corporate administration and legal and administrative law. .
